SMS and WhatsApp Messaging Privacy Policy
How we collect, use and protect the mobile phone numbers of our employees and contractors when we send them text and WhatsApp messages about their work.

1. Who we are and what this policy covers
Ecosphere Global Logistics LLC (“Ecosphere”, “we”, “us”) is a freight forwarding and logistics business operating in the United States. This policy explains how we handle your mobile phone number and related information when you agree to receive work-related text (SMS/MMS) and WhatsApp messages from us.
It covers messages we send to our own staff and contractors. It does not cover messages between you and our customers, or any personal use you make of your own device.
2. The information we collect
- Your mobile phone number, and whether the device is company-issued or personally owned.
- Your consent record — the date, time and method by which you opted in, the channels you agreed to, and any later change or withdrawal.
- Message content that we send to you and that you send back to us on these channels.
- Delivery and engagement metadata — timestamps, delivery status, error codes, carrier information and opt-out keywords such as STOP.
3. Why we use your mobile number
We use SMS and WhatsApp for operational communication only. Typical messages include:
- Shift, rota and schedule changes, and cover requests.
- Shipment, customs and exception alerts that need a fast response.
- Time-critical operational updates where email would be too slow.
- Health, safety, security and emergency notifications, including site closures.
- Administrative notices such as system outages, access issues and payroll cut-offs.
- Two-factor authentication and account security codes.
We do not use these channels to send you marketing or promotional material.
4. Your consent
We will only message you on these channels after you have given express written consent, using our staff consent form or an equivalent electronic form.
Giving consent is voluntary. Your employment, engagement, pay, benefits and standing at Ecosphere do not depend on it, and you will not be treated less favorably if you decline or later withdraw it. If you do not consent, we will reach you by email, phone call or in person instead.
Consent is specific to the channels you select. Agreeing to SMS does not mean you have agreed to WhatsApp, or the other way round.
5. How we share information — and what we never share
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as messaging platform providers, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We do not sell your mobile number or your message content, and we do not share it with data brokers, advertisers or lead generators.
To deliver messages we rely on the following service providers, who process the information on our instructions and under contract:
- Twilio Inc. — our messaging platform, which transmits SMS and WhatsApp messages on our behalf.
- Meta Platforms, Inc. — operator of the WhatsApp Business Platform, for WhatsApp messages only.
- Mobile network carriers — who deliver SMS traffic to your handset.
- Microsoft Corporation — where message records are stored within our Microsoft 365 environment.
We may also disclose information where we are required to do so by law, court order or a valid request from a public authority, or where it is necessary to establish, exercise or defend a legal claim.
6. International transfers
Ecosphere operates in both the United States and the United Kingdom. Your information may be accessed by authorized colleagues in our UK division for operational purposes. Where that happens, the transfer is made under appropriate safeguards, including standard contractual clauses where required.
7. Message frequency, rates, and getting help
- Message frequency varies depending on operational need. We expect most staff to receive fewer than 10 messages per week, but volumes may rise during disruption or an emergency.
- Message and data rates may apply. Charges are set by your mobile carrier and are not controlled by Ecosphere.
- To stop messages, reply STOP to any message. You will receive one confirmation and no further messages on that channel. On WhatsApp you may also reply STOP or block the business number.
- To start again, reply START or contact the policy owner named above.

- Carriers are not liable for delayed or undelivered messages.
Opting out of operational messaging does not opt you out of emergency or safety notifications required by law, which we may send by other means.
8. How long we keep the information
We keep your mobile number for as long as you are engaged by Ecosphere and you remain opted in. Message content and delivery logs are retained for 24 months, after which they are deleted or anonymized.
We keep a record of your consent, and of any withdrawal of consent, for four years after it ends. We do this to demonstrate compliance with the Telephone Consumer Protection Act and carrier registration requirements, and we retain nothing beyond what is needed for that purpose.
9. How we protect it
Access to the messaging platform is restricted to named administrators, protected by multi-factor authentication, and reviewed quarterly. Data is encrypted in transit and at rest by our providers. We log administrative activity and investigate any suspected misuse. No system is completely secure, but we take reasonable and appropriate measures to protect your information.
10. Your rights and choices
You may at any time:
- Withdraw your consent, in whole or for one channel only.
- Ask what mobile information we hold about you and request a copy.
- Ask us to correct an inaccurate number or record.
- Ask us to delete your number and message history, subject to the consent record we must retain under section 8.
- Ask us to stop using a personally owned device and issue a company device instead, or to use a different channel.

If you work in California, the California Consumer Privacy Act as amended gives you additional rights over information we hold about you as an employee, including the right to know, to delete, to correct, and to limit the use of sensitive personal information. We do not sell or share your personal information as those terms are defined in that Act. Comparable rights may apply if you are based in Colorado, Connecticut, Texas, Virginia or another state with an applicable privacy law. You will not be discriminated against for exercising any of these rights.
11. Personal devices
If you agree to receive messages on a personally owned device, the device remains yours. We do not install monitoring software on it, and we do not access anything on it other than the messages exchanged with Ecosphere on the numbers you have given us. If you leave Ecosphere or change your number, tell Matt Ward so we can remove or update your record.
12. Changes to this policy
We may update this policy from time to time. If we make a material change to how we use your mobile number, we will notify you and, where the change goes beyond the purposes you originally agreed to, ask for your consent again. The effective date at the top shows when this version took effect.
